Terms of Use
1.Purpose
These Terms of Use ("Terms") set out the conditions under which Glowsoft SAS ("the Studio") makes the game Umbral ("the Game") and its online services (multiplayer, matchmaking, co-op sessions) available, and govern their use by any player ("you", "the User").
2.Acceptance of the Terms
By accessing the Game and its online services, you acknowledge that you have read and accepted these Terms without reservation. If you do not accept them, you must not use the Game. Using the online services also requires compliance with Epic Games' terms applicable to Epic Online Services.
3.Access to the service and Epic account
Online play requires the use of Epic Online Services and, where applicable, an Epic account. You are responsible for keeping your credentials confidential and for any activity carried out through your account. Creating and using an Epic account is subject to the terms of Epic Games, Inc.
Access to the service requires an internet connection. Some features may be subject to age or hardware-compatibility conditions.
4.Rules of conduct
When using the Game, you agree not to:
- cheat, use unauthorized third-party software (cheats, bots, exploits) or alter how the Game works;
- engage in abusive, harassing, hateful, discriminatory or unlawful behavior toward other players;
- disrupt sessions, servers or network infrastructure;
- impersonate a third party or infringe their rights;
- collect other players' data without authorization;
- use the Game for unauthorized commercial purposes.
Any breach may result in sanctions (see §9).
5.Intellectual property
The Game, its code, graphics, audio, the "Umbral" trademark and all of its content are the exclusive property of Glowsoft SAS or its licensors. The Studio grants you a personal, non-exclusive, non-transferable and revocable license to use the Game for strictly personal, non-commercial purposes. No other transfer of rights is granted.
6.User content
If the Game lets you communicate (chat, voice, nickname), you are solely responsible for the content you transmit. You agree not to distribute any unlawful, offensive content or content that breaches these Terms. The Studio reserves the right to moderate or remove any reported or manifestly unlawful content.
7.Service availability
Online services are provided "as is" and "as available". The Studio does not guarantee continuous, uninterrupted availability, in particular due to maintenance, updates, technical incidents or dependencies on third-party services (including Epic Online Services). The Studio may modify, suspend or discontinue all or part of the services, subject to applicable law.
8.Limitation of liability
To the extent permitted by law, the Studio shall not be liable for indirect damages resulting from the use of, or inability to use, the Game, nor for interruptions attributable to third-party services. Nothing in these Terms excludes or limits the Studio's liability for gross negligence or where the law does not allow it. Your statutory consumer rights remain unaffected.
9.Suspension and termination
In the event of a breach of these Terms, the Studio reserves the right to restrict, suspend or terminate your access to the Game and its online services, temporarily or permanently, and where a serious breach occurs (cheating, unlawful behavior, security threats) without prior notice.
10.Personal data
How we process your personal data in connection with the Game is described in our Privacy Policy, which forms an integral part of these Terms.
11.Changes to the Terms
The Studio may amend these Terms at any time. The applicable version is the one in force at the time you use the Game. In the event of a material change, information may be provided to you by an appropriate means.
12.Governing law and disputes
These Terms are governed by French law. In the event of a dispute, you are invited to contact us first to seek an amicable solution. In accordance with applicable regulations, you may use a consumer mediator. Failing an agreement, the competent courts shall be those designated by ordinary rules of law.
